In that time he called himself \"the true president-elect of Brazil,\" then edited the phrase out. He told supporters that President [Luiz Inácio Lula da Silva](https://567politics.com/politicians/luiz-inacio-lula-da-silva)'s win was \"mathematically impossible\" but did not say why. And he asked the Supreme Federal Court (STF) to lift the passport order he left the country without obeying.\n\nHis own Liberal Party (PL) says it accepts the result. Brazil's Federal Police say he is not, legally, a fugitive. In Washington, President Donald Trump says he can stay \"as long as he wants,\" and the U.S. government has not formally recognized Lula's victory.\n\nOur [earlier report](https://567politics.com/news/brazil-flavio-bolsonaro-leaves-after-runoff-october-2026) covered the first three days after the October 25 vote. Lula won 51.79% of valid votes to Bolsonaro's 48.21%. Bolsonaro first called for the vote to be annulled, then said he would seek to void Lula's mandate instead. Justice Alexandre de Moraes ordered him to surrender his passports, and he crossed into Argentina late on October 27, after the deadline had passed. This story picks up from his arrival in the United States on October 28.\n\n**Flávio Bolsonaro's first week abroad**\n\n* **2026-10-26**: He is served Moraes's order to hand over all passports within 24 hours\n* **2026-10-27**: He crosses from Foz do Iguaçu into Argentina at night\n* **2026-10-28**: He lands near Miami and posts a letter calling himself president-elect\n* **2026-10-28**: The electoral court's president says the vote was normal\n* **2026-10-29**: PL leader Valdemar Costa Neto says no one approved the letter\n* **2026-10-30**: He speaks to supporters online; his lawyers file three petitions\n* **2026-10-31**: Trump says he can stay; Rubio denies a direct U.S. role\n\nSource: [CNN Brasil](https://www.cnnbrasil.com.br/politica/ninguem-aprovou-carta-de-flavio-e-bolsonaro-nao-sabia-de-fuga-diz-valdemar/), [Revista Fórum](https://revistaforum.com.br/politica/foragido-flavio-bolsonaro-pede-que-moraes-deixe-caso-willer-tomaz-e-que-mendonca-assuma-investigacao/), [AFP via Buenos Aires Times](https://batimes.com.ar/news/latin-america/rubio-says-us-not-directly-involved-in-flavio-bolsonaros-flight-from-brazil.phtml)\n\n## How he got to Florida\n\nBolsonaro, his wife and their two daughters crossed the bridge from Foz do Iguaçu into Argentina at about 10:50 p.m. on October 27, [CNN Brasil reported](https://www.cnnbrasil.com.br/politica/ninguem-aprovou-carta-de-flavio-e-bolsonaro-nao-sabia-de-fuga-diz-valdemar/). An Argentine migration record obtained by Estadão shows he left Puerto Iguazú airport at 11:52 p.m. using an Italian passport, [as republished by Terra](https://www.terra.com.br/noticias/brasil/politica/flavio-bolsonaro-usou-passaporte-italiano-e-deixou-argentina-as-23h52-mostra-registro-migratorio,ddf6463423fe1f1abcf6bc19571fc68df5wutvdr.html). His Brazilian passports had been canceled. The jet stopped in Guayaquil, Ecuador. Flight-tracking data cited by CNN Brasil show it landed at Miami-Opa Locka Executive Airport at 9:23 a.m. local time on October 28.\n\nThe Federal Police issued a note that day. \"There is no official record of the lawmaker leaving through Brazilian migration control posts,\" it said, [according to CNN Brasil](https://www.cnnbrasil.com.br/politica/pf-diz-que-nao-registrou-saida-de-flavio-em-postos-migratorios-brasileiros/). The note added that travel-document restrictions \"by themselves\" do not make someone a fugitive. Nor do they authorize arrest, surveillance or other precautionary measures. The police said they are investigating how the court orders came to be broken. The quotations are 567politics translations.\n\nWho paid for the flight is not settled. The New York Times and the Wall Street Journal reported that Jason Miller, an adviser to Trump, chartered the plane, [AFP reported](https://batimes.com.ar/news/latin-america/rubio-says-us-not-directly-involved-in-flavio-bolsonaros-flight-from-brazil.phtml). The head of the air-taxi company told AFP that an intermediary paid from a U.S. bank account. Secretary of State Marco Rubio said on October 31 that \"the US government was not involved directly.\" He said Bolsonaro \"had previously held a visa,\" and that Trump \"made a decision to allow him to enter the country.\" Democratic members of Congress have written to Rubio asking for \"an immediate accounting\" of the State Department's role.\n\nBolsonaro entered under humanitarian parole, a temporary permission to enter that usually lasts a year, Reuters reported, [as carried by CNN Brasil](https://cnnbrasil.com.br/internacional/donald-trump-diz-que-nao-tem-planos-de-se-encontrar-com-flavio-bolsonaro). Allies told a [Metrópoles columnist](https://www.metropoles.com/colunas/igor-gadelha/flavio-fugiu-com-a-familia-para-os-eua-e-pedira-asilo-politico-a-trump) on October 27 that he would formally ask for political asylum once in the United States. 567politics found no confirmation that a request has been filed.\n\n## The letter and its edits\n\nHours after landing, Bolsonaro posted a letter. It opened by calling him \"the true president-elect of Brazil,\" [Congresso em Foco reported](https://www.congressoemfoco.com.br/noticia/129620/leia-a-integra-da-primeira-carta-de-flavio-apos-chegar-aos-eua). He wrote that he had not fled, but had left a \"regime of exception.\" He cited \"the political instrumentalization of Justice in Brazil\" and said he would lead the opposition from abroad. He thanked Argentina's President Javier Milei and Trump.\n\nThe letter alleged fraud. It said a Supreme Court ruling had extended voting past the legal deadline, that votes were cast under different rules, and that Lula gained more than 10 million votes between rounds. It also accused the government of abusing its power during the campaign and called for the Lula-Alckmin ticket to be removed. The letter did not attach or cite documents.\n\nMinutes after the first version appeared, Bolsonaro changed \"true president-elect\" to \"leader\" of Brazil, CNN Brasil reported. The first version also carried an outdated national coat of arms reading \"Estados Unidos do Brazil,\" a name the country dropped decades ago.\n\nThe president of the Superior Electoral Court (TSE), Justice Kassio Nunes Marques, answered that evening. The elections \"took place with the most absolute normality and with respect for legal and constitutional rules,\" he said in a note, [CNN Brasil reported](https://www.cnnbrasil.com.br/politica/apos-carta-de-teor-golpista-de-flavio-kassio-diz-que-eleicao-foi-normal/). He acknowledged \"instability in the final stretch of voting\" and said every challenge filed through due process would be answered. In the Senate the same day, Senator Veneziano Vital do Rêgo (MDB) said that \"runaways are unpatriotic,\" and Eliziane Gama (PSD) called the trip \"unacceptable,\" [the Senate news agency reported](https://www12.senado.leg.br/noticias/materias/2026/10/28/senadores-reafirmam-resultado-das-eleicoes). Carlos Portinho (PL) said some Brazilians are \"exiles\" abroad because they do not trust the country's courts.\n\n## Checking the fraud claims\n\nBolsonaro has made three specific claims: that the voting extension changed the rules, that Lula's gain between rounds was suspicious, and that the result was \"mathematically impossible.\" Each can be checked against the TSE's own results files.\n\n**The extension.** On election day, Justice Cristiano Zanin of the Supreme Court extended voting by two hours after reports that buses had not run in several cities, then limited the order to polling places that had not yet closed. Both campaigns had asked the electoral court for extensions, including Bolsonaro's, for towns hit by rain, as our earlier report noted. TSE data show 34,393 votes were counted after 5 p.m., CNN Brasil reported. Lula's margin was 4,430,191 votes, according to the [TSE's national results file](https://resultados.tse.jus.br/oficial/ele2026/6258/dados/br/br-c0001-e006258-u.json). If every late vote had gone to Lula, it would equal less than 1% of his margin. That does not settle whether the extension was lawful, which is a separate question for the courts. It does mean the late votes could not have decided the race.\n\n**The gain between rounds.** The 10 million figure is accurate. Lula received 53,879,538 votes in the first round and 64,256,232 in the runoff, a gain of 10,376,694, according to the TSE's [first-round](https://resultados.tse.jus.br/oficial/ele2026/6257/dados/br/br-c0001-e006257-u.json) and runoff files. Bolsonaro also gained 3,721,538. The pool those gains came from is visible in the same data. Eliminated candidates had won 9,316,747 votes in the first round. The runoff also had 4,781,485 more valid votes, because turnout rose and fewer people voted blank or null. Together that is 14,098,232 votes, exactly equal to the two finalists' combined gain.\n\nLula won about 74% of that pool. That is a large swing. A large or surprising swing, though, is not evidence of fraud. The argument moves from \"this is hard to believe\" to \"this is false,\" which is an argument from incredulity. Proof would require specific irregular sections, machines or counts, and the letter named none.\n\n**\"Mathematically impossible.\"** In an online broadcast to supporters on October 30, Bolsonaro said many things that happened were \"mathematically impossible\" without a \"handball goal,\" [O Tempo reported](https://www.otempo.com.br/politica/2026/10/30/em-live-flavio-bolsonaro-diz-que-fuga-nao-e-fraqueza-e-fala-em-novas-eleicoes-antes-de-2030). He offered no evidence and did not say what the irregularities were, the paper reported. He said he would explain \"very soon.\" A claim that names no testable fact cannot be checked, which is why it carries no evidential weight until it is specified.\n\n## The legal fight in Brazil\n\nBolsonaro is under investigation, not charged. He is a target of two Supreme Court inquiries, [DW reported](https://opovo.com.br/noticias/mundo/2026/11/01/inqueritos-no-stf-e-faltas-no-senado-o-que-pode-acontecer-com-flavio-apos-fuga-para-os-eua.html). One, under Justice André Mendonça, concerns money allegedly linked to banker Daniel Vorcaro and the financing of a film about the Bolsonaro family. The other, under Moraes, concerns his ties to lawyer Willer Tomaz and suspected money laundering involving a betting company. Bolsonaro denies wrongdoing. The police asked the court for the passport measures on October 25, according to the police note.\n\nOn the night of October 30, his lawyers filed three requests, [Revista Fórum reported](https://revistaforum.com.br/politica/foragido-flavio-bolsonaro-pede-que-moraes-deixe-caso-willer-tomaz-e-que-mendonca-assuma-investigacao/). Two went to Chief Justice Edson Fachin. One asks that the Tomaz inquiry move to Mendonça, on the ground that he already oversees a fraud investigation into the same alleged financial structure. The other asks that Moraes be declared barred from the case for bias. It cites alleged links between a company that owns a plane Moraes has used, his wife's law firm and Banco Master. The third request asks Moraes to revoke the passport order. The defense also says a bank denied holding the joint account cited in the order. No ruling had been reported as of November 2, [O Liberal reported](https://www.oliberal.com/eleicoes/flavio-bolsonaro-recorre-contra-apreensao-de-passaportes-1.1189742).\n\nWorkers' Party lawmakers have asked Moraes to order Bolsonaro's arrest and seek an Interpol Red Notice. No decision has been reported. DW reported that a Red Notice is unlikely, since it requires a fugitive whose whereabouts are unknown. Any extradition would need U.S. cooperation. Washington has not acted on earlier Brazilian requests for the blogger Allan dos Santos and former intelligence chief Alexandre Ramagem.\n\n**Weighing the persecution claim.** Bolsonaro says Moraes \"falsely\" involved him in the case and that \"the persecution began\" sooner than he expected, as O Tempo and [AFP reported](https://www.plataformamedia.com/2026/11/02/flavio-bolsonaro-declara-se-preparado-para-enfrentar-perseguicao-mas-direita-brasileira-nao-o-acompanha-com-video/). His objection to Moraes is now a formal bias petition, which the court must decide on the record. Two facts limit the broader claim. The passport measures were requested by the Federal Police, not begun by the justice on his own. And by the police's own account, the passport order did not make him a fugitive or expose him to arrest. On the other side, the fact that he left does not prove he is guilty, a point our earlier report made about Lula's reaction. Both inferences go beyond what the record shows.\n\n## His party moves on\n\nThe PL's leaders have kept their distance. \"Not even Bolsonaro knew, nobody knew, I didn't know either,\" party president Valdemar Costa Neto said on October 29 after visiting Jair Bolsonaro, the senator's father, [CNN Brasil reported](https://www.cnnbrasil.com.br/politica/ninguem-aprovou-carta-de-flavio-e-bolsonaro-nao-sabia-de-fuga-diz-valdemar/). \"He went through a difficult situation, we understand, but we don't approve,\" he said. He said no one in the party approved the letter. A party note signed by Valdemar recognizes the result the TSE proclaimed. Senator Rogério Marinho, who ran the campaign, said its core team was not told about the departure in advance. Marinho also told reporters there is \"no proof\" of fraud and called the letter an outburst, [France 24 reported](https://acento.com.do/france24/de-presidente-legitimo-electo-a-lider-redacto-chatgpt-la-polemica-carta-de-flavio-bolsonaro-9780896.html).\n\nSão Paulo Governor [Tarcísio de Freitas](https://567politics.com/politicians/tarcisio-de-freitas) said in a video that he understood the senator's \"indignation.\" \"But the way forward is to respect the result of the ballot box and move on,\" he said, [Correio Braziliense reported](https://www.em.com.br/politica/2026/11/7531634-fuga-de-flavio-bolsonaro-do-pais-deixa-vacuo-na-lideranca-da-oposicao.html). Michelle Bolsonaro said her husband, [Jair Bolsonaro](https://567politics.com/politicians/jair-bolsonaro), who is serving a 27-year sentence under house arrest for plotting a coup after the 2022 election, had asked the right for \"a moment of unity, and not of looking for culprits,\" AFP reported.\n\nBolsonaro, for his part, said in the October 30 broadcast that he was not talking about the 2030 election but about \"before that.\" He urged supporters to press senators to elect Marinho as Senate president instead of [Davi Alcolumbre](https://567politics.com/politicians/davi-alcolumbre) when the new Congress meets on February 1, 2027. Alcolumbre says he has at least 48 votes, more than the 41 he needs in a secret ballot, [Revista Fórum reported](https://revistaforum.com.br/politica/alcolumbre-48-votos-senado/), a count that cannot be confirmed before the vote. The PL will hold 29 of 81 seats. Many in the opposition want the Senate to act on impeachment requests against Moraes, which Alcolumbre has said he will not advance. Related maneuvering in the Chamber is in our report on [Hugo Motta's electoral reform push](https://567politics.com/news/brazil-chamber-mixed-district-voting-proposal-motta-october-2026).\n\n## Washington and Buenos Aires\n\nTrump has spoken about the election at least four times since the vote without formally recognizing the result. On October 26 he said, \"It looked like another rigged election, frankly,\" without offering evidence, [the AP reported](https://www.bostonglobe.com/2026/10/26/world/brazil-lula-leftist-denies-trump-ally/). On October 28, asked about Bolsonaro entering the country, he said, \"It would be OK with me,\" [CBS News reported](https://www.cbsnews.com/news/brazil-flavio-bolsonaro-u-s-visa-presidential-election-loss/). On October 29 he said Lula had asked him not to take sides, \"and I didn't.\" He called the election \"a great embarrassment for the Brazilian people\" and pointed to falling markets, [Poder360 reported](https://www.poder360.com.br/poder-eleicoes-2026/lula-me-pediu-para-nao-tomar-lado-nas-eleicoes-no-brasil-diz-trump/). A market fall shows how investors reacted to the winner. It says nothing about whether votes were counted correctly, so the inference does not follow. On October 31 he said Bolsonaro \"got treated very shabbily\" and called the election \"disgraceful,\" AFP reported. Reuters reported that Trump has no plans to meet him or to back his political ambitions.\n\nAs of October 28, the United States, Argentina and Israel had made no official statement recognizing the result, while Brazil's Foreign Ministry counted more than 200 messages of congratulation, [CNN Brasil reported](https://www.cnnbrasil.com.br/blogs/isabel-mega/eleicoes/apos-vitoria-lula-recebe-congratulacoes-de-mais-de-100-paises/). DW reported on November 1 that the Trump administration still had not done so, [according to O Povo](https://www.opovo.com.br/noticias/brasil/2026/11/01/marco-rubio-nega-que-eua-tenham-ajudado-na-fuga-de-flavio-bolsonaro.html). Foreign Minister Mauro Vieira and Rubio spoke briefly at a G20 reception in Atlanta on October 30, with no specific topic discussed, diplomatic sources told DW.\n\nBrazil also summoned Argentina's chargé d'affaires, María Emilia Cortés, to explain how Bolsonaro used Argentine territory to leave, [Correio Braziliense reported](https://www.correiobraziliense.com.br/politica/2026/10/7530993-itamaraty-convoca-representante-da-argentina-apos-fuga-de-flavio.html). She said she would pass the request to Milei. Argentina's foreign minister, Pablo Quirno, wrote on X: \"FALSE. There was no request for information.\" A Brazilian diplomatic source called it a routine meeting, AFP reported. Brazil withdrew its ambassador from Buenos Aires in July after insults from Milei.\n\n## The Senate seat and the electoral court\n\nBolsonaro's Senate term ends on January 31, 2027, and he still draws a salary of R$46,366.19 a month, DW reported. Under Article 32 of the Senate's rules, a senator who misses a third of the year's deliberative sessions without leave loses the seat. The Senate's governing board declares the loss after hearing the senator's defense, with no floor vote, [Poder360 reported](https://www.poder360.com.br/poder-congresso/flavio-pode-atingir-maximo-de-faltas-no-senado-e-perder-mandato/). Poder360 counted 11 unexcused absences, including October 28. The counts of sessions held and left differ slightly between outlets, but the threshold is roughly 24 absences. Deputy Sâmia Bomfim of PSOL has said she would ask the board to strip his mandate and suspend his pay. Two lawyers have also asked a federal court in Rio to halt his salary and allowances, [ConJur reported](https://conjur.com.br/2026-nov-01/em-acao-advogados-pedem-suspensao-de-salario-de-flavio-bolsonaro/). Neither request had been decided.\n\nAt the TSE, cases accusing both campaigns of abuse of power are still open. CNN Brasil counted at least 22 such cases, naming Lula in 15 and Bolsonaro in 7, [in a review of court records](https://www.cnnbrasil.com.br/eleicoes/disputa-entre-lula-e-flavio-continua-no-tse-mesmo-apos-o-fim-das-eleicoes/). A count published by UOL found 21, with 11 naming Lula and 10 naming Bolsonaro, [Folha de Alphaville reported](https://folhadealphaville.com.br/nacional/2026/10/29/tse-tem-21-acoes-envolvendo-lula-e-flavio-que-podem-resultar-em-cassacao-e-inelegibilidade.html). None has been judged. For the winning ticket, a guilty finding could void the diploma or the mandate. For the losing side, it could mean fines and eight years of ineligibility. The TSE must certify the winners by December 18, and Lula takes office on January 5, 2027, [Congresso em Foco reported](https://www.congressoemfoco.com.br/noticia/129709/pos-eleicao-entenda-os-passos-ate-a-posse-dos-vencedores-de-2026). No certification date had been announced as of November 1.\n\nSeparately, Justice [Flávio Dino](https://567politics.com/politicians/flavio-dino) of the Supreme Court ordered a police inquiry on October 27 into possible foreign interference on Bolsonaro's behalf, [ConJur reported](https://conjur.com.br/2026-out-27/dino-manda-investigar-interferencia-dos-eua-a-favor-de-flavio-nas-eleicoes/). Police are to examine whether money or services reached his campaign through Brazilian businessmen linked to Rockbridge, a U.S. political network that Vice President JD Vance co-founded. They will also look at who paid foreign social media profiles to promote him, whether any talks were tied to U.S. interest in Brazil's rare earths, and claims about platform algorithms. Dino wrote of a \"possible instrumentalization\" of party politics for foreign interests. The order opens an inquiry; it is not a finding. One businessman named in reporting, Tallis Gomes, denied any role in the campaign or its funding. ConJur reported no response from Bolsonaro's campaign.\n\n## What to watch\n\nSeveral questions remain open. Fachin and Moraes have not ruled on the defense petitions, and Moraes has not ruled on the arrest request. It is not known whether Bolsonaro has applied for asylum, or whether the U.S. will formally recognize Lula's win. The Senate board has not acted on his absences. Background on the election is on our [Brazil election guide](https://567politics.com/elections/brazil), and on his brother, who also lives in the United States, in our profile of [Eduardo Bolsonaro](https://567politics.com/politicians/eduardo-bolsonaro).\n\nCampaign finance note: Brazilian candidates file campaign accounts with the Superior Electoral Court. This article did not review those filings.\n\n## Photo and reporting note\n\nFile image for context, not a photograph of the events reported here.
